Inspite of granting time on 20/07/2015, learned Government Pleader is unable to get instructions from the second respondent. The petitioners complain against the action of second respondent in not receiving the deed of cancellation of mortgage and execution of a fresh mortgage deed in favour of another Nationalised Bank.
2. From the material available on record, it is evident that the subject matter of the writ petition is subjected to mortgage on 16/11/2009. The property is stated
to have been purchased through registered sale deed dated 02/09/2004. The petitioners are given liberty to present the document referred to above before the second respondent and the second respondent is directed to receive the document, consider registering the same in accordance with the provisions of Registration Act. If for any reason the second respondent finds difficulty for registration, appropriate orders are passed and communicated to the petitioners. This exercise shall be completed within a period of one week from the date of receipt of copy of this order.
3. The writ petition is disposed of. No order as to costs.
4. As a sequel, Miscellaneous Petitions if any, pending in this writ petition shall stand closed.
