I.A.NO.2 OF 2023 We have heard learned counsel appearing for the review applicant/Punjab National Bank as well as learned Senior Counsel appearing for the respondent No.1/Writ Petitioner on the merits as well as the maintainability of the present Review Application.

Counsel for the review applicant/ Punjab National Bank has placed the order under review dated 21.12.2022 and the order passed by the Supreme Court on 18.05.2023 in a Special Leave Petition filed by the review applicant/Punjab National Bank by which the review applicant was given the liberty to move the High Court in exercise of its review jurisdiction in respect of the grievance raised by the review applicant/Punjab National Bank.

The order under review refers to two decisions of Co-ordinate Benches of this Court on similar facts.

In the first decision, the interest was adjudged to be paid at 18% per annum.

The Division Bench (consisting of one of us, Sri Justice J Sreenivas Rao) accordingly noted the decisions and allowed the Writ Petition by awarding 12% interest per annum for balancing the equities between the petitioner (auction purchaser) and the respondent-Bank (review applicant) before us.
