HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.44074 of 2016 Order:

This Writ Petition was filed challenging the action of the respondents 3 and 4 in causing interference in the civil disputes at the behest of the 5th respondent and threatening to vacate and handover Shop No.10/627, Anacuta Road, Santhapet, Nellore, to the 5th respondent, though the petitioner is in lawful possession by virtue of rental agreement entered with the Wakf Board.

Today, when the matter is taken up for consideration, learned Government Pleader for Home produced before this Court the written instructions, which states as follows.

"It is submitted that in compliance with the above directions of the Hon'ble Court, the investigation is in progress without arresting the petitioner herein (A2). The allegation of the petitioner that under the influence of the 5th respondent herein, the respondents 3 and 4 have called the petitioner to the police station on 21.11.2016 and threatened him to hand over the shop to the 5th respondent, otherwise to implicate him in false criminal cases is absolutely false and baseless. It is submitted that the 3rd respondent has been conducting investigation in Cr.No.177 of 2016 strictly in accordance with law. On completion of the same, an appropriate report will be filed before the concerned Hon'ble Court.

It is submitted that the respondents 3 and 4 have never interfered in the civil disputes of the petitioner with 5th respondent herein nor threatened the petitioner to vacate and handover the Shop No.10/627, Anacutta Road, Santhapet, Nellore to the 5th respondent at any point of time. All these allegations are totally false, baseless and invented only for the purpose of filing this writ petition and as such, the same are hereby specifically denied." In view of the same, no further orders are necessary in the present Writ Petition. The Writ Petition is, accordingly, closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
