HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 10767 of 2016 ORDER:

Heard learned counsel for the petitioners, Government Pleader for Municipal Administration and Urban Development and learned Standing Counsel for Narsipatnam Municipality. With the consent of all the parties, the main writ petition is taken up for disposal at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not giving exemption to the Jamia Masjid/Mosque, a religious building bearing Door No.5-6, Ward No.2 of Narsipatnam Municipality, under Section 88 of the Municipalities Act, 1965, as arbitrary, illegal and improper and consequently to set aside the Special Notices No. 113607318 dated 31.01.2016; 1136009112 dated 25.01.2016 and 1136007906 dated 23.01.2016 issued by the third respondent for payment of property tax. Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the third and fifth respondent to dispose of the revision dated 27.02.2016 and representation dated 08.04.2016 at the earliest.

Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the third and fifth respondent to dispose of the revision dated 27.02.2016 and representation dated 08.04.2016 made by the petitioners, in accordance with law, as

expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of the order, if the same are made and still pending consideration. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
