THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.23233 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue Writ of Mandamus to declare the action of the respondents 2 to 4 in continuing the blue corner notice issued against petitioner's son i.e., A1 to secure his presence in F.I.R.No.10/2014 on the file of the 3rd respondent in spite of securing anticipatory bail by him in Crl.M.P.No.1558/2014 and released on anticipatory bail as highly illegal, arbitrary exercise of power and violatiove of Article 21 of the Constitution of India and consequently direct the respondents 2 to 4 to recall the blue corner notice issued against petitioner's son i.e., A1 in FIR No.10/2014 forthwith." Heard Sri K. Chidambaram, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.

Today, when the matter is called, learned Government Pleader for Home has placed on record an order passed by this Court in W.P.M.P.No.6711 of 2015 in W.P.No.3213 of 2015 dated 06-03-2015, wherein this Court permitted the petitioner therein to move the concerned Court for withdrawal of Look Out Circular (LOC).

In view of the above and for the reasons recorded in the above mentioned order, dated 06-03-2015 in W.P.M.P.No.6711 of 2015 in W.P.No.3213 of 2015, the writ petition is disposed of,

permitting the petitioner herein to move the Court of Addl. Judicial Magistrate of First Class, Tadepalligudem, West Godavari district, where C.C.No.469 of 2014 is pending and make appropriate application, seeking withdrawal of blue corner notice. The petitioner herein is at liberty to set out the reasons for making the said request also. If any such application is made by the petitioner, the learned Addl. Judicial Magistrate of First Class, Tadepalligudem, West Godavari District shall consider the same, in accordance with law, and pass appropriate orders, as expeditiously as possible, preferably within a period of four (4) weeks from the date of filing such application. There shall be no order as to costs.
