HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.4983 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/ accused Nos.4 to 6 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.114 of 2015 of Bommuru Police Station, Rajahmundry, East Godavari District, which is outcome of report given by the 2nd respondent-de facto complainant, no other than wife of the accused, for the offences punishable under Section 498-A IPC and Sections 3 & 4 of Dowry Prohibition Act.

2) Heard learned counsel for the petitioners/ accused Nos.4 to 6 as well as learned public prosecutor representing 1st respondent-State before admission and before ordering notice to respondent No.2. Perused the material on record.

3) As the material falls short for this Court to admit the application under Section 482 Cr.P.C, the same is disposed of including any objection under Section 188 Cr.P.C vide Thota Venkateshwarlu vs State of A.P through Prl. Secretary & another[1] is only for trial or enquiry, with the following observations. The investigation shall go on.

The arrest of the petitioners pending investigation is dispensed with as accused No.4 is resident of USA, accused No.5 is resident of Dubai and accused No.6 is resident of Karnataka State in their avocation. Any

remedy is left open to petitioners among others in the event after police filing final report and taken cognizance by the learned Magistrate for any offence against any of them. 4 ) Miscellaneous petitions, if any pending, shall stand closed.
