THE HON'BLE SRI JUSTICE DILIP B.BHOSALE CIVIL REVISION PETITION No. 3270 of 2014 ORDER:

This C.R.P. is against the order dated 05.09.2014, passed by the XI Additional Chief Judge, City Civil Court, Hyderabad on I.A.No.548 of 2014 in C.M.A.No.88 of 2014. By the impugned order, the first appellate Court has allowed the application and suspended the order, dated 07.08.2014, passed by the trial Court on I.A.No.427 of 2014 in O.S.No.533 of 2014.

Having regard to the overall facts and circumstances of the case, learned counsel for the parties have stated that I need not record reasons for disposing of this C.R.P. and they have agreed for the following order:

"The first appellate Court, wherein C.M.A.No.88 of 2014 is pending, shall decide the same as expeditiously as possible and preferably within three months from today. The petitioner is directed to produce copy of this order before the first appellate Court within one week from today.

It is made clear that this Court has not examined merits of the case. The first appellate Court shall consider and decide the C.M.A., on merits in accordance with law and without being influenced either by this order or the order impugned in the present C.R.P. All contentions on merits are kept open."

C.R.P. is accordingly disposed of. No order as to costs. Consequently, miscellaneous petitions, if any, also stand disposed of.
