HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18275 OF 2009 ORDER:

The writ petition is filed questioning the action of the respondents in removing the petitioner from service in the middle of the academic year.

The case of the petitioner is that he joined as a Daily Wage Junior Assistant on 23.09.2008 in the office of the 2nd respondentschool and his services were sought to be dispensed with by the 1st respondent on 23.07.2009 on the instructions of the 2nd respondent. Thereafter, the petitioner had submitted a representation on 27.07.2009 to the 3rd respondent explaining all the grievances and the 3rd respondent forwarded the same to the 1st respondent on 30.07.2009, but no action was taken so far. Hence, the writ petition. Counter-affidavit has been filed on behalf of the 2nd respondent. While admitting the writ petition, this Court gave a direction to the 2nd respondent to consider the petitioner's representation dated 27.07.2009 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of the order. Today, when the matter is taken up for hearing, learned counsel for the 2nd respondent submits that the petitioner is being continued on daily wages and he is also being paid the salary as applicable as on date.

Learned counsel for the petitioner submits that inasmuch as the petitioner is continued in service, the relief which is sought in the writ petition stands granted no further orders are required to be passed. Recording the submissions of both the counsel the writ petition is closed. No order as to costs.

Miscellaneous Petitions pending, if any, in this writ petition shall also stand closed.
