THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No. 3637 OF 2018 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure by the petitioner/A.1 challenging the order, dated 13.03.2018 in Criminal Revision Petition No.196 of 2017 on the file of the Metropolitan Sessions Judge, Hyderabad, whereby and whereunder, the learned Metropolitan Sessions Judge allowed the revision petition filed by the complainant and directed the petitioner herein/A.1 to surrender before the XII Additional Chief Metropolitan Magistrate, Hyderabad. The learned counsel for the petitioner/A.1 would submit that the petitioner/A.1 has absolutely no disregard for the order and he is ready to surrender before the XII Additional Chief Metropolitan Magistrate, Hyderabad, but his only apprehension is that on his surrender, he may be remanded to the judicial custody on the observation that so far no bail was granted to him. He, thus, prayed to pass a protective order while directing him to surrender before the XII Additional Chief Metropolitan Magistrate, Hyderabad.

The learned Additional Public Prosecutor left the matter to the discretion of the Court.

It is informed to this Court that C.C.No.252 of 2016 is now at the stage of receiving the additional charge sheet filed by the investigating officer. Considering the same, the petitioner/A.1 is directed to surrender before the XII Additional Chief Metropolitan Magistrate, Hyderabad, as directed in the impugned order in Criminal Revision Petition No.196 of 2017. On such surrender, he shall be enlarged on bail on the same day on his executing a bond for Rs.50,000/- (Rupees fifty thousand only) with two sureties each for likesum to the satisfaction of the said Court. Needless to

emphasize, the petitioner/A.1 shall assist the trial Court for smooth completion of the trial.

The criminal petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, shall stand disposed of. _______________________ U.DURGA PRASAD RAO, J 28.03.2018 Note: Issue order copy today.
