THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.11932 OF 2016 ORDER:

The Writ Petition is filed challenging the action of the respondents in issuing notice No.G1/ UCJ/ W.NO.117/ CIR14/ WZ/ GHMC/ 2016 dated 10.03.2016, as illegal and arbitrary. The petitioner is the Crime Branch CID Officers' Cooperative Housing Society Limited. The Society has purchased land admeasuring an extent of Acs.10.31 guntas in Sy.No.145/ 2, Hydernagar village, Rajendernagar Taluk, Ranga Reddy District and made layout and sold the plots to its members. The Society has retained an extent of about 40 square yards of land, adjacent to plot No.10 and constructed three rooms and arranged provisions for the purpose of its members since the provisions stores are far away from the said land. The 2nd respondent issued the impugned notice directing the petitioner to remove the said rooms. Hence, this writ petition.

Heard and perused the material available on record. Learned Standing Counsel for the 2nd respondent submitted that the notice under Section 452(1) of the Hyderabad Municipal Corporation Act, was already served on the petitioner and the Society has also submitted its explanation and after obtaining the explanation, the 2nd respondent considered the same and rejected the request of the petitioner, and then only the impugned proceedings were issued, and that the 2nd respondent is proceeding in the matter in accordance with law by following due procedure .

Recording the above submissions of the learned Standing Counsel for the 2nd respondent, the Writ Petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
