THE HON'BLE JUSTICE SRI T. SUNIL CHOWDARY CIVIL REVISION PETITION No.1312 of 2016 ORDER:

This Civil Revision Petition is filed by the Decree Holder, under Section 115 of CPC, challenging the order dated 02.9.2015 passed in E.P.No.5 of 2015 in O.S.No.88 of 2012 on the file of the Court of Junior Civil Judge, Gannavaram, Krishna District. 2.

Heard the learned counsel for the petitioner. 3.

A perusal of the record reveals that by the impugned order, the executing Court ordered attachment of the salary of the first respondent-Judgment Debtor on 20.3.2015 and hence the E.P. was closed.

No interim order is granted by this Court from 2016 on wards. As per the Proviso to Section 60(i) of CPC, salary is liable to attached for a continued period of twenty-four months. The attachment period of twenty-four months is already over. In view of the Proviso to Section 60(i) of CPC, the purpose of filing of the revision has become infructuous.

Hence, the civil revision petition is dismissed as infructuous. Miscellaneous petitions, if any pending in this revision petition, shall stand closed.
