THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT CRIMINAL PETITION No.15158 of 2016 ORDER:
Vide the present petition, the petitioners/A.2 to A.8 seek a direction thereby directing the Station House Officer, Manthani Police Station, Karimnagar District to enlarge them on bail in the event of their arrest in connection with FIR No.101 of 2016 registered for the offences punishable under Section 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act.
As per the complaint, the marriage of the complainant was performed on 13.11.2015 with Accused No.1/Balasani Avinash, who is a Software Engineer, as per Hindu rites and customs. At the time of marriage, her parents gave an amount of Rs.10,50,000/- as dowry and other gifts. After marriage, the complainant lived with her husband/A.1 for two months happily and after two months, on the ground that he is a Software Engineer, started demanding Rs.20 lakhs in addition. On that pretext, he started harassing her both physically and mentally and used to beat her. She has informed the attitude of her husband to her in-laws, but they said that their son is a software engineer and three times more than what they have given, girls would marry their son and they also used to beat her and torture her.
Learned counsel appearing on behalf of the petitioner submits that A.1 husband of complainant has already granted bail by the lower Court. The marriage has taken place on 13.11.2015. She remained with her husband only for 1 1⁄2 month. Thereafter A.1/husband of the complainant filed petition under Section 9 of Hindu Marriage Act, 1955 before the Senior Civil Judge at Peddapalli. If there is any dispute that is only temporary in nature between A.1 and the complainant, however the petitioners have played no role in their differences. The present case is nothing but to put a pressure on the petitioners.
Without commenting on the role of the petitioners in the present case, since A.1 has already been released on bail, and as the petitioners are family members of A.1, I hereby direct the Station House Officer concerned to enlarge the petitioners/A.2 to A.8 on bail in the event of their arrest on furnishing a personal bond of Rs.10,000/- (Rupees ten thousand only) each with one surety of the like sum each to their satisfaction.
Accordingly, the Criminal Petition is allowed. Miscellaneous Petitions, if any pending, shall stand closed.
