HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11896 of 2019 ORDER:

The grievance of the petitioners is that the Tahsildar, Maheshwaram Mandal, Ranga Reddy District, is not effecting mutation in their favour pursuant to the proceedings issued under Section 5-A of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, resulting in a certificate in Form 13-B which was issued as long back as on 05.2.1992.

Perusal of the record reflects that the petitioners never approached the Tahsildar concerned by way of an application in Form VIA as required by Section 4 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971 read with Rule-18 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989, in the event they wanted mutation to be carried out on the strength of Form 13-B certificate. Without making an application in the prescribed format, it is not open to the petitioners to complain of inaction on the part of the revenue authorities. The Writ Petition is accordingly disposed of permitting the petitioners to make an application in the prescribed format in Form VIA along with the requisite fee and necessary documents to the Tahsildar, Maheshwaram Mandal, Ranga Reddy District. In the event such an application is made, the Tahsildar, Maheshwaram Mandal, Ranga Reddy District, shall take appropriate action thereon expeditiously and in any event, not later than four weeks from the date of receipt thereof.
