THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 3078 of 2022 & CRIMINAL PETITION NO.3104 OF 2022 COMMON ORDER:

These two Criminal Petitions are filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioners, who are arrayed as accused Nos.1 and 2, on bail in connection with Crime No.78 of 2022 of Valigonda Police Station registered for the offence punishable under Section 306, 324, 504 r/w.34 of Indian Penal Code.

Heard the learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

Briefly stated, the case of prosecution is that the de facto complainant is the mother of the deceased, who filed complaint stating that the petitioners - accused Nos.1 and 2 bet the son of the de facto complainant for keeping the counter open. Feeling insulted the deceased committed

suicide. The sole reason for committing the suicide by the deceased is beatings which as inflicted by these petitioners when the deceased insisted to give toddy on credit. The petitioners are in jail since 17.03.2022. Since it is the solitary incident of beating, for which reason the petitioners can be released on bail.

The petitioners in both the petitions i.e. Accused No.1 and 2 are directed to be released on bail on their executing personal bonds for Rs.25,000/- (Rupees twenty five thousand only) each, with two sureties each for like sum to the satisfaction of the learned Principal Judicial Magistrate of First Class, Ramannapet. The petitioners shall appear before the police concerned, on every 1st and 3rd Thursday, for a period of three months.

Accordingly, these Criminal Petitions are allowed. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
