Petitioners And The State of Telangana, rep., by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.9843 OF 2018 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for respondents 1 to 3. 2.
Apprehending that as a consequence of the comprehensive survey of revenue records, the Tahsildar, Abdullapurmet Mandal, Ranga Reddy District, is taking steps to grant pattadar passbook and title deeds in favour of unofficial respondents 4 and 5, this Writ Petition is filed. According to petitioners, they applied for grant of Occupancy Rights Certificates (ORCs) under the Andhra Pradesh (Telangana Area) Inams Abolition Act, 1955 and enquiry is pending before the Revenue Divisional Officer, Ibrahimpatnam Division, Ranga Reddy District, and at this stage, if pattadar passbooks and title deeds are granted in favour of respondents 4 and 5, grave prejudice would be caused to the petitioners. 3.
Learned counsel for the petitioners drawn the attention of this Court to the letter dated _.8.2017 informing the Tahsildar that the enquiry to issue ORCs is pending before him. 4.
If that is so, it cannot be assumed at this stage that the Tahsildar would not enquire into the issue before granting pattadar passbooks and title deeds. However, so far no decision is taken. The cause in the Writ Petition is premature. Hence, this Court is not inclined to entertain the Writ Petition.
5.
The Writ Petition is accordingly dismissed leaving it open to the petitioners to work out their remedies, if adverse decision is
made by the Tahsildar pending ORCs before the Revenue Divisional Officer. There shall be no order as to costs. Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
