ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner who is arrayed as accused No.5 in Crime No.127 of 2026 of Mahabubnagar Rural Police Station, Mahabubnagar District, registered for the offences punishable under Sections 108 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The brief facts of the case are that, on 13.03.2026, the de-facto complainant lodged a report before the police stating that the deceased was earlier in a relationship with one Bhargavi - accused No.2. Subsequently, Bhargavi developed a relationship with Raghavender - Accused No.1, which led to disputes. When the deceased questioned accused No.1, he was threatened, and later, accused No.2 along with her parents - accused Nos.3 and 4 allegedly harassed and humiliated the deceased and his family during meetings and through phone calls. Due to continuous mental harassment, threats, and public humiliation, the deceased became disturbed and on the night of 13.03.2026, he committed suicide by hanging. Hence, the complainant requested to take necessary action. Based on the said complaint, the police registered a case against the petitioner for the aforementioned offences.

Heard Sri Sai Reddy Ravindar Reddy, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and has been falsely implicated, except for his presence at a panchayat. The petitioner has no connection whatsoever with the alleged abatement of suicide and that the allegations do not constitute an offence under Section 108 of the BNS. It is further submitted that the petitioner is ready to co-operate with the investigating authority. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Addl. Public Prosecutor opposing the petition stating that there are clear allegations against the petitioner and that due to the abatement of this petitioner only, the victim committed suicide and the learned counsel also filed documents and statement of the witnesses. Therefore, he prayed the Court to dismiss the petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is

arrayed as accused No.5 and that going through the suicide note written by the victim, one Raghavendra is only responsible for the suicide and the petitioner name is not mentioned by the victim in the suicide note. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation and also considering the suicide note written by the victim, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to compliance of the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Mahabubnagar Rural Police Station, Mahabubnagar District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in

Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
