ORDER:
This writ petition is filed for a mandamus to declare the action of respondent Nos.1 to 3 in not appointing the petitioner as an authorized dealer for Fair Price Shop No.43, Chinnagangammagudi Street, Tirupathi pursuant to the report given by respondent No.2 in ROC No.ASO/12/2012, dated 20.01.2012, as illegal and arbitrary and consequently, to direct the respondents to appoint the petitioner as the authorised dealer for the said shop in the vacancy covered by the death of his father on 01.03.2010 while working as fair price shop dealer to the said shop.
2. Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies (Andhra Pradesh) appearing for the respondents.
3. The Government issued G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-1) Department, dated 28.2.2014 framing new guidelines for appointment of fair price shop dealers on compassionate grounds. In view of the same, the petitioner is given liberty to apply afresh in terms of the said Government Order and as and when the petitioner applies, the respondents shall consider the same in accordance with law.
4. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
