THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.9823 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Land Acquisition.

When the matter is taken up, written instructions, dated 28.03.2018, furnished by the R&R Officer & Project Officer, ITDA, K.R.Puram, West Godavari District, are placed on record by the learned Government Pleader. To the extent of their relevance, the said instructions read as under: "In this connection it is submitted that the lands in Sy.No.34, 87/1C, 89/1A, 89/2A and 89/3A etc., of Rowthugudem village of Jeelugumilli Mandal were notified by the R&R Officer 7 Project Officer, ITDA, KR Puram. At the time of award enquiry the petitioners have attended before the LAO and stated that they are not willing to part with their lands for acquisition and requested to exclude their lands from acquisition.

The LAO has considered their request as the lands of willing non tribes only are being acquired and discarded their extents from acquisition proceedings. Since the land of the petitioners has not been acquired vide this office Award No.02/2016-17/R&R, dated 25.02.2017 there is no likelihood of respondents interfering with the lands of the petitioners". In view of the above, by placing on record the contents of the above said instructions, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the Writ Petition, shall stand closed. __________________ A.V.SESHA SAI,J 06th April, 2018 Tsy
