THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 26718 OF 2017 O R D E R:
This writ petition is filed seeking a Mandamus to declare the inaction of respondent Nos.2 to 4 in carrying out the investigation in Crime No.91 of 2016 as illegal and arbitrary. Respondent No.4 filed a counter-affidavit. It is not necessary for this Court to refer to the entire averments made in the counteraffidavit except that the investigation has been completed and a requisition has been submitted to the Sub-Divisional Police Officer, Nellore on 12.08.2017, as required under the procedure, to enable respondent No.4 to take necessary action and on account of the internal changes, there is a slight delay in taking decision by the Sub-Divisional Police Officer. In those circumstances, interests of justice would be served if a direction is issued to the Sub-Divisional Police Officer, Nellore to take decision on the requisition, dated 12.08.2017, and communicate the same to respondent No.4 within ten days from today, and respondent No.4 to take appropriate steps under Section 173 Cr.P.C. within two weeks thereafter.
Learned Government Pleader for Home (Andhra Pradesh) shall inform the same to the Officer concerned through mail/letter. Accordingly, the writ petition is closed.
Consequently, the miscellaneous petitions, if any shall stand closed.
