Petitioner initially worked as attender and later promoted as Staff Assistant. Petitioner claims that he became sick and could not attend to duties. After he recouped from his ailment, he was allowed to work for some time and later from October, 2015, he was not even allowed to work, and no order of termination from service is made. Therefore, orally the authority cannot refuse the petitioner to work and such action is illegal. Inspite of submitting representations for condoning his lapses and for admitting to duty, so far petitioner is not admitted to duty.

The claim of the petitioner is that he is not allowed to work from October, 2015 and such action of the respondents is illegal. The facts on record do not disclose the exact reasons for his absence and whether any action is taken by the competent authority against the petitioner.

Learned counsel for the petitioner fairly submits that petitioner may be permitted to make a detailed representation ventilating his grievance and a direction be issued to the competent authority to consider such representation. 5.

Having regard to the said submissions, the writ petition is disposed of granting liberty to the petitioner to make a representation ventilating his grievance to the District Cooperative Officer (3rd respondent). As and when such representation is made the 3rd respondent is directed to examine the claim of the petitioner

- 3 - and pass appropriate orders, as warranted by law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
