THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL MISCELLANEOUS APPEAL No.1951 OF 2004 JUDGMENT:
When the matter was listed on 24.08.2017, there was no representation for the appellant and, therefore, Registry was directed to list the matter under the caption 'for dismissal'. However, on 30.08.2017, learned Standing Counsel for the appellant sought adjournment and, accordingly, the matter was adjourned. Today, despite the matter being listed under the caption 'for dismissal', there is no representation for the appellant. It appears, the appellant is not inclined to prosecute the present appeal. Hence, the present Civil Miscellaneous Appeal stands dismissed for non-prosecution.
