HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3102 OF 2022 ORDER:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner - Accused No.1 seeking bail in the event of his arrest in connection with Crime No.39 of 2022 on the file of Karankote Police Station, Vikarabad District registered for the offence punishable under Section 306 of Indian Penal Code.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondentState and perused the record. 3.
The allegation against the petitioner is that the petitioner developed illicit intimacy with the deceased's elder brother's wife. In view of the said relationship, there was quarrel between the deceased, petitioner and his brother. Due to the said quarrel, the petitioner filed a complaint of causing grievous injury and threatening,
which was registered as Crime No.38 of 2022 by the Police, Karankote, Vikarabad District. It is further alleged that for the reason of filing a complaint, the deceased was frustrated and committed suicide. 4.
As seen from the allegations, the petitioner had illicit intimacy with deceased brother's wife and in the quarrel in between the petitioner, his mother and the deceased elder brother, the petitioner filed a criminal complaint as stated above, for which reason of filing complaint, the deceased was humiliated and committed suicide. In the said circumstances, the petitioner can be granted anticipatory bail, when there are no other allegations except the complaint being lodged by petitioner. 5.
The Criminal Petition is accordingly allowed and the petitioner/accused No.1 is granted anticipatory bail subject to the following terms and conditions: (1) The petitioner/accused No.1 is directed to surrender before the Station House Officer, Karankote Police Station, Vikarabad District within ten days from the date of this order and on
such surrender, the said Station House Officer shall release the petitioner/accused No.1 on bail on his executing a personal bond to the tune of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties to the like sum each to his satisfaction.
(2) The petitioner/accused No.1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.
(3) The petitioner shall attend the concerned police on every Sunday for a period of two months. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
