THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 3025 of 2022 ORDER:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioners who are arrayed as accused Nos.1 and 2, seeking bail in the event of their arrest in connection with Crime No. 61 of 2022 on the file of Jagtial Rural Police Station registered for an offence punishable under Section 306 of Indian Penal Code. 2.

The allegation against the petitioners is that they have sold a piece of land to Dr.Guduri Hemanth; that the deceased (L.Srinivas Reddy) was working with the said doctor in his hospital; and that the deceased mediated in the purchase of land by the doctor from these petitioners. The allegation is that though money was received from the doctor, the petitioners were harassing the deceased.

The learned Public Prosecutor produced copy of suicide note dt.05.03.2022 in which it is specifically written that the petitioners were harassing the deceased

in the said land transaction asking for money, though money was paid.

Learned counsel for petitioners submits that there is no reference of the suicide note produced by the learned Public Prosecutor in the trial Court order. 5.

Non-mentioning or non-production of the suicide note before the trial Court when the Anticipatory Bail application was heard will not preclude this Court from looking into the suicide note produced by the prosecution.

As argued by the learned Public Prosecutor, at this juncture, this Court cannot compare the signature on the agreement and the suicide note of the deceased. The same is left open for the purpose of investigation. 7.

In the said circumstances, no case is made out by the petitioners for grant of anticipatory bail. 8.

Accordingly, this petition is dismissed.
