HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL MISCELLANEOUS APPEAL No.961 of 2010 JUDGMENT :
This appeal is preferred against order dated 03.11.2010 in I.A.No.1036 of 2010 in O.S.No.172 of 2010 on the file of Senior Civil Judge, Peddapalli.
2. Appellants herein are plaintiffs and they filed the above referred suit O.S.No.172 of 2010 for the relief of perpetual injunction and in that they filed I.A.No.1036 of 2010 for temporary injunction and trial Court on a consideration of material on record, dismissed the application holding that prima facie case and balance of convenience are not in favour of appellants.
3. As seen from the office note, the main suit itself is posted for trial and as the main relief in the suit is also for perpetual injunction in stead of deciding merits and demerits of the case at interlocutory stage, I feel that the appeal can be disposed of directing the trial Court to dispose of the suit at an early date.
4. For these reasons, appeal is dismissed directing the trial Court to dispose of the suit as expeditiously as possible without being influenced by any of the observations or findings made in the interim order.
5. Miscellaneous petitions pending, if any, shall stand closed. No costs.
