THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.910 OF 2015 ORDER:

The petitioners, who are Accused Nos.1 & 2, filed this Criminal Petition under Section 438 Cr.P.C., seeking release in the event of their arrest in connection with Crime No.84 of 2014 of Srikalahasti II Town Police Station, Chittoor District, registered for the offences punishable under Sections 420, 406 & 506 IPC. At the time when the matter came up for consideration, the learned Public Prosecutor, on instructions, submits that earlier the petitioners filed Crl.P.No.No.13413 of 2014 under Section 438 Cr.P.C. seeking anticipatory bail and after arguing for a considerable period of time, the said criminal petition was dismissed as withdrawn on 19.11.2014. Thereafter, the petitioners filed Crl.P.No.14240 of 2014 seeking quashing of the proceedings in the present crime. By an order, dated 05.12.

2014, this Court dismissed the said criminal petition and directed the police not to arrest the petitioners till completion of the investigation. In view of the above, I am not inclined to consider the request of the petitioners. However, since the offences alleged against the petitioners are punishable with imprisonment of less than seven years, the Investigating Agency shall scrupulously follow the judgment of the apex Court in Arnesh Kumar Vs. State of Bihar and another (Criminal Appeal No.1277 of 2014) before taking any coercive steps against the petitioner.

With the above direction, the Criminal Petition is disposed of.
