THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.11930 of 2019 ORDER:
The petitioner assails the inaction of the revenue authorities upon her representation dated 15.02.2019.
Perusal of the said representation demonstrates that a certain extent of land in Mittapalle Village of Siddipet Mandal originally stood in the name of the petitioner's father who died some time prior to the year 1980. The petitioner also admits that the names of her brothers have already been entered in the revenue records in the pattadar and possessor column in relation to the lands owned by her deceased father. She apprehends that her share in her father's property may not be given to her and on this basis she requested the revenue authorities not to entertain any application for mutation or issuance of pattas/title deeds. As the representation itself demonstrates that mutation has already been effected, the representation made by the petitioner serves no purpose. A hierarchy of remedies is provided under the Telangana Rights in Land and Pattadar Pass Books Act, 1971, if a person is aggrieved by the mutation effected by the recording authority in relation to a particular land.
Without taking recourse to such remedies, the petitioner cannot assail the inaction on the part of the revenue authorities upon a representation made by her.
The writ petition is therefore misconceived in its very inception and is accordingly dismissed. This order shall however not preclude the petitioner from taking recourse to the remedies available to her in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
