W.P.No.11884 of 2019 HACJ & Dr. SAJ ORDER: (Per the Hon'ble the Acting Chief Justice Raghvendra Singh Chauhan) Burugupalli Paramesh, the petitioner, has filed this Habeas Corpus Petition, inter alia, on the ground that his wife, Naini Jyothi, is being detained illegally by her parents, despite the fact that she is his lawfully wedded wife. In accordance with the order, dated 18.06.2019, the respondents have produced Mrs. Jyothi before this Court. This Court has spoken to Mrs. Jyothi.

She informs this Court that she is 25 years old young lady, who has completed M.B.A. According to her, she and the petitioner were married on 21.05.2019. Although presently she is living with her grandmother, with whom she has lived ever since her childhood, but she would like to return to her matrimonial home, and to live with the petitioner. This Court has also spoken to Mr. Burugupalli Paramesh, the petitioner. He informs this Court that because of the intercaste marriage, Jyothi's parents are not agreeable to the said marriage. Therefore, they have taken her away from his home. He further informs this Court that he is an Interior Designer, who runs a small firm employing five permanent employees, and five temporary employees. His earning is about Rs.75,000/- per month. According to him, he shall be more than happy to keep Jyothi, and to lead a happy married life.

W.P.No.11884 of 2019 HACJ & Dr. SAJ Since Mrs. Jyothi is a major, who wants to be reunited with her husband, the respondents are directed to handover her custody to the petitioner forthwith.

With these observations, this Writ Petition stands allowed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
