HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.11935 of 2019 ORDER:

With the consent of both the parties, this Writ Petition is being disposed of at the admission stage.

This Writ Petition is filed seeking a Writ of Mandamus declaring the proceedings dated 13-02-2019 issued by the 2nd respondent, as arbitrary, illegal and discriminatory and violative of Articles 14 and 16 of the Constitution of India and also declare that the petitioner shall be reinstated into service forthwith. 3.

Heard Sri Srinivasa Rao Madiraju, learned counsel for the petitioner and the learned Government Pleader for Services-I appearing for respondents.

Petitioner contends that he is working as a Principal of Government Junior College, Dichpally of Nizamabad District and while he was discharging duties, the respondents placed him under suspension vide impugned proceedings on the ground that he has demanded and accepted bribe from one Mekala Gangadhar, Physical Director, Government Junior College, Armoor, Mubarak Nagar, Nizamabad. The grievance of the petitioner is that the 2nd respondent has not initiated any disciplinary action, after placing him under suspension.

Learned counsel for the petitioner submits that the petitioner is on the verge of retirement and since he is retiring within

AKS,J W.P.No.11935 of 2019 eight months, let the disciplinary proceedings initiated against the petitioner be concluded within a reasonable period of time. Therefore, appropriate orders may be passed in the Writ Petition directing the disciplinary authority to conclude the proceedings initiated against the petitioner within a period of six months in accordance with Rules.

Learned Government Pleader for Services-I submits that if the 2nd respondent intends to continue the disciplinary proceedings initiated against the petitioner, it will be concluded within a period of six months.

Having regard to the rival submissions made by the parties, this Court is of the considered view that the Writ Petition can be disposed of directing the 2nd respondent to conclude the disciplinary proceedings within a period of six months from the date of receipt of a copy of this order, if he intends to continue the disciplinary proceedings initiated against the petitioner. 8.

With these observations, the Writ Petition is disposed of. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
