This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ A.1 to A.5, to quash the proceedings in C.C.No.150 of 2019 on the file of II Special Metropolitan Magistrate, Rajendranagar, registered for the offences punishable under Sections 341, 323, 506 read with 34 of IPC.
2 .
Heard the learned counsel for the petitioners/ A.1 to A.5, the learned Additional Public Prosecutor representing the 2nd respondent/ State and perused the record.
3 .
Though the learned counsel for the petitioners/ A.1 to A.5 filed this Criminal Petition for quashing the proceedings in C.C.No.150 of 2019 on the file of II Special Metropolitan Magistrate, Rajendranagar, he restricts his prayer to dispense with the personal appearance of the petitioners/ A.1 to A.5 before the trial Court on each and every date of adjournment. 4 .
The learned Additional Public Prosecutor conceded the said request of the learned counsel for the petitioners/ A.1 to A.5. 5 .
In view of the submissions made by both the learned counsel and having regard to the facts and circumstances of the case, this Court is satisfied that personal appearance of the petitioners/ A.1 to A.5 before the trial Court in the subject Calendar Case can be dispensed with. Accordingly, the learned II Special Metropolitan
Magistrate, Rajendranagar, is directed not to insist for the personal appearance of the petitioners/ A.1 to A.5 in C.C.No.150 of 2019 on each and every date of adjournment, until and unless their personal appearance is so warranted.
