W.P.No.40972 of is filed challenging the proceedings of the 2nd respondent dated 13.06.2015 allowing the application of the 4th respondent for issuance of Pattedar Pass Books and Title Deeds in favour of the 4th respondent for an extent of 3.00 Acres in Survey No.120 and 1.00 Acre in Survey No.356 of Badinehal Village, Kowthalam Mandal, by cancelling the Pattadar Pass Books and Title Deeds earlier issued in favour of the petitioner. Originally, the 4th respondent filed an application before the 3rd respondent and when the 3rd respondent rejected that application, the 4th respondent preferred an appeal before the 2nd respondent. 2.

Now, it is submitted by both the counsel, before this Court, that 2nd respondent has no jurisdiction to entertain the appeal against the order passed by the 3rd respondent and the only remedy available to the 4th respondent is to go before the Joint Collector. 3.

Accordingly, W.P.No.40972 of 2015 is allowed and the impugned order passed by the 2nd respondent on 13.06.2015 is set aside and liberty is given to the 4th respondent to prefer an appeal to the Joint Collector, within a period of 30 days

from the date of receipt of the order and pursue the same in accordance with law. In view of allowing of W.P.No. 4.

Miscellaneous petitions pending consideration, if any, in these Writ Petitions shall stand closed in consequence. No order as to costs.
