THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.11703 OF 2015

O R D E R

The prayer of the petitioner in this case is as under: 'The Hon'ble Court may be pleased to issue a writ or order more particularly one in the nature of writ of mandamus declaring the action of the respondents in not registering FIR against the persons mentioned in petitioner complaint dated 11-3-2015 which was acknowledged by the 5th respondent vide acknowledgment No.122 dated 11-3-2015 as illegal, arbitrary, unjust and consequential directions to the respondents to register the FIR against the persons mentioned in petitioner complaint dated 11-32015 and make arrest of them immediately and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case.'

The Sub-Inspector of Police, Kothagudem III Town Police Station, filed a counter-affidavit stating that upon the complaint made by the petitioner earlier, Crime No.40 of 2012 under Sections 447 and 427 IPC and Crime No.78 of 2013 under Sections 198 and 417 IPC read with Section 34 IPC were registered on the file of Kothagudem III Town Police Station and C.C.No.27 of 2014 was pending for trial in relation to Crime No.78 of 2013.

Perusal of the complaint dated 11.03.2015 which is the subject matter of the present writ petition reflects that there was no specific allegation made by the petitioner in relation to any subsequent event which warranted registration of a crime. Only a general complaint was made thereunder which is stated to be only a reiteration of the earlier complaint which had already been resulted in the registration of crimes. Therefore, this Court finds no reason to direct the police authorities to register one more crime on the basis of the present complaint filed by the petitioner.

The writ petition is devoid of merit and is accordingly dismissed.

Pending miscellaneous petitions shall also stand dismissed in the light of this final order. No order as to costs.
