HONOURABLE JUSTICE G. SRI DEVI CRIIVINAL REVISION CASE No.36 I of 2021 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 Cr.P C. against the order, dated 07 04.2021 in Crl M.P No 335 of 2020 in Cr.No.193 of 2020 (of P.S.Penpahad) onthefileof the lAdditional District and Sessions Judge, Nalgonda.

The petitioner filed Crl.M.P No.335 of 2020 seeking interim custody of Maruthi Ertiga Car bearing No.TS 29 F 7327 seized in Cr.No.193 of 2020 registered for the offence under Section 20(ii)(b) of NDPS Act, 1985. The learned Judge, vide impugned order, allowed the said petition directing to return the said car to petitioner on his furnishing Bank guarantee for Rs.3,00,000/- with certain conditions. Seeking to modify the said Bank guarantee, the petitioner filed the present revision. 3.

Learned counsel for the revision petitioner submits that due to Covid-19 situation, the petitioner is unable to furnish such Bank guarantee and thus, he prays to reduce the said Bank guarantee. 4.

ln view of the nature of offence allegedly committed by accused and as the value of car is mentioned in the affidavit as Rs.3,00,0001, the Court below has.rightly gave direction to petitioner to furnish such Bank guarantee. Hence, there are no grounds to interfere with the said order. 5.
