HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 23185 of 2002 ORDER:

When the matter is taken up for hearing today, learned counsel for the petitioner and learned standing counsel for the 1st respondent have fairly conceded that the issue raised in the writ petition is squarely covered by the orders dated 16.02.2018 passed by this Court in W.P.No.19952 of 2002 and prayed that similar orders may be passed in the writ petition.

Following the aforesaid orders, the impugned order to the extent of directing the petitioner to pay interest for the delayed payment of gratuity, is set aside. The interest amount which the petitioner had deposited before the appellate authority under the Payment of Gratuity Act is directed to be refunded to the petitioner and the petitioner is at liberty to withdraw the same. The writ petition is, accordingly, disposed of.
