THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.25282 of 2011 ORDER:

This writ petition was filed challenging the notification dated 16.10.2007 issued by the Central Board of Secondary Education insofar as it amended Rule 69.1 of Chapter IX of the Examination Bye Laws relating to corrections in the name/surname of the candidate or in the names of the father/mother.

Smt. A.Chaya Devi, learned counsel for the Central Board of Secondary Education, filed a counter-affidavit wherein it was stated that the impugned notification no longer holds the field as the Board issued a notification on 25.06.2015 further amending Rule 69.1 of the Examination Bye Laws relating to correction and change in the names. In the light of the aforestated development, Ms.S.Madhavi, learned counsel representing Mr. C.Raghu, learned counsel for the petitioner, concedes that the issue raised in the writ petition has been rendered purely academic owing to the subsequent amendment and seeks leave to withdraw the writ petition reserving liberty to the petitioner to challenge the present amendment of the rule effected by way of the new notification.

The writ petition is accordingly dismissed as withdrawn with the liberty aforestated.

Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
