The present transfer petition, under Section 24 of the Code of Civil Procedure, 1908, is filed seeking to withdraw F.C.O.P.No.325 of 2016 from the file of Judge, Family Court, Visakhapatnam, and transfer the same to the file of Judge, Family Court, Vijayawada.

2. Heard Sri Suresh Kumar Potturi, learned counsel for the petitioner - wife.

3. No representation for the respondent - husband.

4. F.C.O.P.No.325 of 2016 pending on the file of Judge, Family Court, Visakhapatnam, is filed by the respondent seeking restitution of conjugal rights.

5. Learned counsel for the petitioner would submit that the petitioner is having a tender aged child of 2 1⁄2 years, when this petition was filed; that she is a resident of Vijayawada, working as a Lecturer to eke out livelihood and she has no male assistance to travel to Visakhapatnam to attend the Court with the small child.

6. Keeping in view, the reasons shown by the petitioner, the request is acceded to.

7. Hence, the present transfer petition is allowed. Consequently, F.C.O.P.No.325 of 2016 pending on the file of Judge, Family Court, Visakhapatnam, is withdrawn and transferred to the file of Judge, Family Court, Vijayawada, for disposal in accordance with law, after issuing notices to the parties on receipt of the case bundle.
