THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11322 of 2016 ORDER:

This writ petition, filed under Article 226 of the Constitution of India, challenges the order passed by the Project Director, DWMA, Krishna - 2nd respondent herein vide proceedings Rc.No.78/A2/2013, dated 23-03-2015.

Heard Sri Suresh Kumar Potturi, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj for respondent Nos.1 and 2 and Sri M.S.R. Chandramurthy, learned counsel for respondent No.3.

By virtue of the impugned order, the 2nd respondent herein placed the petitioner out of contract temporarily while asking the petitioner to submit the explanation. Responding to the same, according to the petitioner, he submitted an explanation. According to the learned counsel for the petitioner, the very action of the 2nd respondent in placing the petitioner out of employment is highly illegal, arbitrary and impermissible and the facts and circumstances of the case do not warrant of issuance of such suspension order.

On the contrary, it submitted by learned Standing Counsel for respondents that there is absolutely no illegality nor there exists any procedural infirmity in the impugned action. As per the material available on record, the 2nd respondent

placed the petitioner under suspension as long back as on 23-032015 and according to the petitioner, he submitted an explanation also. Having regard to the nature of controversy, this Court deems it appropriate to dispose of the writ petition with a direction to the respondents to complete the enquiry and to pass final orders in the matter by fixing some timeframe.

For the aforesaid reasons, the writ petition is disposed of, directing the 2nd respondent - Project Director to pass appropriate orders pursuant to the impugned proceedings, dated 23-03-2015 vide Rc.No.78/A2/2013, within a period of six (6) weeks from the date of receipt of a copy of this order.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
