THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.14594 OF 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus to declare the impugned action of respondent No.6 herein of imposing the sentence of 'Reduce to Ranks' by holding trial constituting himself as the Summary Court Martial on 15.03.2003 which consequentially resulted in the premature discharge of the petitioner herein from service and its subsequent confirmation by the Statutory Appellate Authority respondent No.4 herein vide his order dated 07.07.2004 as being violative of petitioner's Fundamental Rights guaranteed under Articles 14, 16 and 21 of the Constitution of India.

No representation is made on behalf of the petitioner on 30.03.2016. Learned counsel for the respondents is present. Today also, there is no representation on behalf of the petitioner even though the matter is listed under the caption 'for dismissal'. It seems that the petitioner is not interested to prosecute the matter. Hence, the Writ Petition is dismissed for default. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
