THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3038 of 2022 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioners/A-1 to A-6 seeking to grant anticipatory bail in the event of their arrest in connection with Crime No.93 of 2021 of Atmakur (Wanaparthy) Police Station, Wanaparthy, registered for the offences punishable under Sections 324, 504 read with 34 of I.P.C.

Heard the learned counsel appearing for the petitioners/A-1 to A-6, learned Public Prosecutor appearing for the respondent-State and perused the record. 3.
According to the prosecution, the petitioners allegedly beat the de facto complainant and others in the disputed land in survey No.287 of JuralaVillage. Both parties filed complaints, which came to be registered as Crime Nos.93
and 94 of 2021. The present complaint is registered as Crime No.93 of 2021.

During the course of hearing, the learned Public Prosecutor submits that the section of law altered to Section 326 IPC. It is a dispute between two groups, wherein case and counter cases are filed and custodial interrogation may not be required. The accused in Crime No.94 of 2021 were directed to be released on bail in the event of their arrest by this Court by order, dated 07.02.2022 vide Crl.P.No.531 of 2022.
5. Having regard to the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners/A-1 to A-6.

The Criminal Petition is accordingly allowed and the petitioners/A-1 to A-6 are granted anticipatory bail subject to the following terms and conditions:
(1) The petitioners/A-1 toA-6 is directed to surrender before the Station House Officer, Atmakur
(Wanaparthy) Police Station, Wanaparthy District, within a period of fifteen days (15) days from today and on such surrender, the said Station House Officer shall release the petitioners/A-1 to A-6 on bail on their executing personal bonds to the tune of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties to the like sum each to his satisfaction.
(2) The petitioners/A-1 to A-6 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case and appear before him as and when directed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
