HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.25771 OF 2017 ORDER:

This writ petition is filed to declare the action of the respondents in creating Nursing Tutor Grade-II posts vide G.O.Ms.No.23, dated 08-02-2017 as an amendment to G.O.Ms.No.202, dated 26-07-2012 and trying to fill-up vacancies in Warangal, Zone-V as illegal and arbitrary. Learned counsel for the petitioners submits that the petitioners are all working as staff nurses and their promotion to lecturers will be get affected. He says that post of Nursing Grade-II is not existing under service rules. As such filling up of posts is illegal. On the other hand, learned Government Pleader for Services says that though earlier tutor post is existing under G.O.Ms.No.202, dated 26-07-2012 under service rules contained in the said G.O., the same are redesignated as Nursing Tutor Grade-II as per G.O.Ms.No.23, dated 08-02-2017 and he submits that it will not affect the petitioners and petitioners have no locus standi to challenge the same.

In this case, it is to be seen that Tutor post is existing even as per G.O.Ms.No.202, dated 26-07-2012 and by amending G.O.Ms.No.202, amended G.O.Ms.No.23, dated 08-02-2017 is issued, whereunder Tutor posts are

re-designated as Nursing Tutor Grade-II with different pay scale and it is not known how the same will affect the promotion of the petitioners to the post of lecturers. As such, the petitioners cannot have any grievance in respect of filling-up of posts of Nursing Tutor Grade II. Accordingly, I do not find any merit in the writ petition.

Hence, the writ petition is dismissed. As a sequel to the disposal of this writ petition, miscellaneous petitions, if any, pending shall stand closed.
