THE HON'BLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No.4333 OF 2015 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, to quash the proceedings in Cr.No.192 of 2015 of Chikkadpally Police Station, Hyderabad, registered for the offences punishable under Sections 420, 468 and 120 read with 34 I.P.C..

Heard both sides.

Alleging that the petitioners/A2 and A3 forged the signature of respondent No.2-complainant and withdrawn the amount from the Bank, respondent No.2 filed a complaint before the Chikkadpally Police Station, Hyderabad. Based on the same, the aforesaid crime was registered against the petitioners/A2 and A3 and another. The allegations in the complaint, prima facie, reveal the commission of offences punishable under Sections 420, 468 and 120 read with 34 I.P.C. by the petitioners/A2 and A3. This is a matter, which requires investigation by the police, and there are no valid grounds to quash the First Information Report. Having regard to the facts and circumstances of the case, the Criminal Petition is disposed of, directing the Investigating Agency to proceed with the investigation, however, without arresting the petitioners/A2 and A3 in connection with Cr.No.192 of 2015 of Chikkadpally Police Station, Hyderabad.

Miscellaneous Petitions, if any, pending in this petition shall stand closed.
