THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI AND THE HON'BLE SRI JUSTICE PULLA KARTHIK WRIT PETITION No.36614 OF 2015 ORDER: (per AKS,J) This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners aggrieved by the order, dated 30.07.2014, passed in O.A.No.9081 of by the Administrative Tribunal, Hyderabad (for short, 'the Tribunal'). 2.
Heard the learned Government Pleader for Services-II appearing for the petitioners.
3.
Learned Government Pleader appearing for the petitioners had contended that the respondent No.1 is a retired Sub-Registrar. At the time of her retirement, disciplinary proceedings were pending against her. After her retirement, the State has conducted a detailed enquiry and for the proven misconduct, imposed a punishment of 50% cut in pension for a period of five years, vide G.O.Rt.No.1570, Revenue (VigilanceVI) Department, dated 24.10.2013. Aggrieved by the same, the respondent No.1 has approached the Tribunal by filing the
AKS,J & PK,J W.P.No.36614 of 2015 subject O.A. and the Tribunal, vide impugned order, dated 30.07.2014, was pleased to set aside the punishment imposed vide G.O.Rt.No.1570, dated 24.10.2013, without appreciating any of the contentions raised by the petitioners. 4.
Learned Government Pleader had further drawn our attention to the order, dated 22.12.2015, passed by this Court, wherein this Court was pleased to suspend the operation of the impugned order, and contended that since five years have lapsed, with the efflux of time, the effect of punishment also would come to an end. Further, the interim order, dated 22.12.2015, passed by this Court had served the purpose of the petitioners and, admittedly, the respondent No.1 would be entitled for full pension, after expiry of five (5) years. Now, we are in the year 2023. Therefore, the cause in the Writ Petition does not survive for adjudication.
5.
This Court, having considered the said submissions, is of the view that since the impugned order, dated 30.07.2014, passed by the Tribunal was suspended by this Court vide order, dated 22.12.2015, it would mean that by the efflux of
AKS,J & PK,J W.P.No.36614 of 2015 time, the purpose for which the present Writ Petition was filed has been served and as on today, the cause in the Writ Petition does not survive for adjudication.
6.
With the above observations, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
