THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3045 of 2022 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner, who is accused No.1, to grant anticipatory bail in the event of his arrest in connection with Crime No.382 of 2018 of Godavarikhani-I Town Police Station, registered for the offences punishable under Section 304-B and 498-A of Indian Penal Code and Section 4 of Dowry Prohibition Act.

Heard the learned counsel appearing for the petitioner/A-1 and the learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

In this case, investigation has been completed and due to abscondance of Accused No.1 and 4, police filed charge sheet filed against A2, A3 and A5 to A8 onlh and undertook to file supplementary charge sheet as and when Accused No. 1 and 4 are arrested and produced before the Court.

The learned Counsel for the petitioner submits that Accused No.4 has already been enlarged on bail by the VI Additional Sessions Judge, Godavarikhani.

The learned Assistant Public Pleader submits that there is no further investigation to be conducted as far as petitioner is concerned and the police are relying upon the charge sheet filed against A2, A3, A5 to A8.

In these circumstances, the petitioner/accused No.1 is directed to appear before the I Additional Judicial Magistrate of First Class, Godavarikhani and upon his surrender, the learned Magistrate shall enlarge the petitioner on bail on his furnishing a personal bond to the tune of Rs.50,000/- (Rupees fifty thousand only) with two sureties to the like sum each to his satisfaction. Since the learned Assistant Public Prosecutor submits that there is no investigation pending, police shall file a memo to that effect and accordingly the learned Magistrate shall commit the
case against the petitioner to the court of VI Additional Sessions Judge, Godavarikhani on or before 13.04.2022 on which the date the Sessions Case No.199 of 2021 stands posted. In the event of failure on the part of the petitioner to appear either before the Magistrate or Sessions Court, as directed, the order shall stand cancelled. The Sessions Judge shall take all such necessary steps to ensure completion of trial.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
