ORDER

This writ petition is filed seeking the following relief; "to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of respondents 1 to 4 in constructing an electrical sub-station in the Venkatapalem Kunta/Public Tank situated in an extent of Ac.5.77 cents in R.S.No.410 of Kothagudem Village H/o.Devarapalli, West Godavari District as illegal, arbitrary and in violation of Article 14 of the Constitution of India and consequently direct the respondents not to construct the electrical sub-station in the premises of Venkatapalem Kunta/Public Tank situated in an extent of Ac.5.77 cents in R.S.No.410 of Kothagudem Village H/o.Devarapalli, West Godavari District".

2. Today, when the matter is taken up, learned Standing Counsel for respondents 1 and 2 has placed on record a letter bearing No.DEE/O/NDD/ADM/IAO/U2/D.No.460/15, dated 12.02.2015, received from the Divisional Electrical Engineer, Operation Division, A.P.E.P.D.C Ltd., Nidadavole, wherein it is stated that the construction of the Sub-station at Nallakulakunta H/o.Kothagudem, Devarapalli Mandal, Gopalapuram Sub-division was held up and to avoid the same, Sub-station was constructed at Ramannapalem of Devarapalli Mandal.

3. In view of the above subsequent development, nothing survives for adjudication in the writ petition.

4. Accordingly, the Writ Petition is closed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition

shall stand closed.
