THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE T.RAJANI WRIT APPEAL NO.931 OF 2017 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} Ms. Naseeb Afshan, learned counsel for the appellant, states that, instead of seeking an adjudication on the merits of the order, the appellant-writ petitioner would file a petition before the learned Single Judge to set aside the order dismissing the Writ Petition for non-prosecution.
In view of the submission made by the learned counsel for the appellant, we see no reason to examine the appeal on merits. The Writ Appeal fails and is, accordingly, dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
