The action of the respondents in demanding wheeling charges vide Letter No.CE/Coml/ADE-1/Wh.charges/D.No.465/2003 dated 23.07.2003 of the 1st respondent, and Letter No.SE/OP/NLG/SAO/HT/D.No.261/2003 dated 28.07.2003, is challenged before this Court.

Heard Sri B. Srinivasa Rao, learned counsel for the petitioner and Sri G.R. Vinod Reddy, learned counsel for the respondents. 3.

At the hearing, both the learned counsel submit that the issue in this writ petition is squarely covered by the Judgment dated 18.04.2003 passed by a Division Bench of this Court in RCI Pow er Limited v. Union of I ndia1.

Recording the submission, this writ petition also stands allowed in terms of the judgment dated 18.04.2003 passed by this Court in RCI Pow er Limited (referred supra). No costs. Pending miscellaneous petitions, if any, shall stand closed.
