THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4371 OF 2017 ORDER:
The inaction of respondent Nos.4 and 5, as against respondent Nos.6 and 7, who are alleged to have encroached upon land belonging to Sri Seetha Rama Swamy Temple, admeasuring Ac.0.30 cents in Sy.No.13, Ganeswarapuram Revenue Village, Yerraobanapalli Village, Darsi Mandal, Prakasam District, is questioned in this Writ Petition as being illegal and arbitrary.
Heard the learned Government Pleader for Endowments.
In as much as it is the duty of the respondent - authorities to ensure and protect the properties belonging to the temple. Interest of justice would be served if a direction is issued to the authorities concerned to take into consideration the complaint made by the petitioners and, in the event, it is found that respondent Nos.6 and 7 have encroached the land belonging to the temple, necessary steps shall be taken to evict them by following due process of law. The entire exercise, with regards taking decision and implementation, shall be concluded within a period of eight weeks from the date of receipt of a copy of this order, and the same shall be communicated to the petitioners. The Writ Petition is disposed of accordingly. No costs.
Miscellaneous petitions pending, if any, shall stand closed.
