HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.10276 of 2005

ORDER

This writ petition is filed seeking the following relief: "....to issue a suitable order, direction or writ, particularly one in the nature of Certiorari and hold and declare that the order passed by the 1st respondent in S.E.Appeal No.3 of 2004, dated 24.03.2005 as illegal and unjustified and consequently to quash and set aside the same and to allow the petition with costs."

When the matter is taken up for hearing, learned counsel appearing for the petitioner submits that the Authority under Shops and Establishments Act, 1988 had directed the petitioner-company to pay an amount of Rs.48,584/- to the respondent-workman and during pendency of the writ petition, 50% of the said amount was disbursed to the respondent-workman.

Learned counsel appearing for the respondent-workman submitted that if the petitioner-company pays remaining 50% of the amount to the respondent-workman, it would meet the ends of justice of justice.

Having considered the rival submissions made by the learned counsel on either side, without going into the merits of the case, this Writ Petition can be disposed of directing the

petitioner-company to pay balance 50% of the amount to the respondent-workman.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions pending, if any, shall stand closed.
