THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.33948 of 2014 ORDER:
Heard Sri J.U.M.V.Prasad for petitioners and the Assistant Government Pleader (Home) for respondents.
The petitioners pray for the following relief :- " ....... to issue an appropriate writ, order or direction more especially one in the nature of Writ of Mandamus declaring the action of the respondents in harassing the petitioners and interfering into their site bearing Municipal No.2-51/ A (Old No.2-51/ 4), admeasuring 316.30 sq. yards in Sy.No.89, and bearing house No.2-68/ 3 and 5, admeasuring 240 sq. yards situated at Gachibowli village, Serilingampally Mandal, R.R. District, is bad, illegal, contrary to law and mala fide in nature and consequently to direct the respondents not to interfere with the possession of the petitioners over the sites bearing municipal No.2-51/ A (Old No.2-51/ 4), admeasuring 316.30 sq. yards in Sy.No.89, and bearing house No.2-68/ 3 and 5, admeasuring 240 sq. yards situated at Gachibowli village, Serilingampally Mandal, R.R. District in the interest of justice....."
Briefly stated the grievance of petitioners is that respondents 2 to 4 are interfering with the possession and enjoyment of petitioners of the subject matter of writ petition and such interference is illegal and unconstitutional. Hence, the writ petition.
The 4th respondent filed counter affidavit and by way of reply, it is stated that the 4th respondent received Lr.No.G/ 231/ TPS/ Circle-XI/ 2014, dated 01-11-2014 from the Deputy Commissioner of Police, Madhapur Zone, Hyderabad, requesting to provide sufficient police force for demolition of tin sheds on road margin by GHMC officials and except for that purpose, it is stated that the possession of petitioners is not interfered.
The statement of the 4th respondent is placed on record. The writ petition is closed as no further order is necessary. No order as to costs.
