CVNR,J C.R.P.No.2110 of 2018 06.04.2018 ORDER:

Ex parte interim order of attachment, dated 07.02.2018, in E.P.No.34 of 2017 in Case No.255/2011-12 on the file of the learned Principal Senior Civil Judge, Visakhapatnam, is assailed in this Civil Revision Petition.

Mr.Paravastu Krishna, learned counsel for the petitioner, has submitted that his client has already filed an application before the Court below for stay of execution of the aforementioned attachment order and the same is pending.

As the petitioner has already availed the remedy with reference to the order under revision, I am not inclined to adjudicate the validity or otherwise of the said order on merits at this stage. Instead, the Court below is directed to consider the application stated to have been filed by the petitioner for stay of execution of the aforementioned attachment order and pass appropriate orders, after hearing both sides, within a period of four weeks from the date of receipt of a copy of this order. 4.

Subject to the above direction, the Civil Revision Petition is disposed of.
