THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 16180 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner is working as a Fair Price Shop Dealer of Shop No.4 of Sadashivpet Town and Mandal, Medak District. While so, on 13.05.2015 the Deputy Tahsildar (CS), Sadashivpet Mandal, submitted a report stating that the petitioner sent the PDS wheat for sale in open market and on the basis of the same, the 4th respondent passed the impugned order on 19.05.2015 keeping another dealer incharge of the shop run by the petitioner. There are no proceedings initiated against the petitioner under Section 6-A of the Essential Commodities Act, though a report was submitted by the Deputy Tahsildar on 13.05.2015. Be that as it may, the 4th respondent is not competent to pass the impugned order and the learned Government Pleader does not dispute the same.

3. In the circumstances, the order passed by the 4th respondent dated 19.05.2015 is set aside and the Writ Petition is allowed. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 10th June, 2015 cbs
